Terms & Conditions
Last updated: 25 October 2026
1. Introduction
Welcome to iNdima Kids. These Terms & Conditions govern your use of our website and your purchase of products or booking of services through iNdima Kids.
Our current offerings include children's books and event childcare services, including wedding childcare, birthday and private event childcare, corporate family events, and children's activity corners.
By using our website, placing an order, or requesting a booking, you agree to the terms applicable to that transaction. Nothing in these terms excludes or limits any consumer rights that cannot lawfully be excluded under South African law.
2. About iNdima Kids
iNdima Kids is a South African children's brand operating in the children's products and event services space.
- Trading name: iNdima Kids
- Email: indimakids@gmail.com
3. Website Use
You agree to use our website lawfully and not to:
- Interfere with the website's security or operation.
- Attempt unauthorised access to our systems or data.
- Submit false or misleading information.
- Use the website for fraudulent, unlawful, or harmful purposes.
- Copy or exploit our website content for commercial purposes without permission.
We may update website content, product information, and services as our business evolves.
4. Products and Services
Children's books
Our product pages describe the books and products currently available for purchase. Customers should review the product description, price, and delivery information before placing an order.
Event childcare
Our event childcare services are subject to availability and the requirements of each event.
We currently focus on Johannesburg and Gauteng. Enquiries outside this area may be considered individually but are not guaranteed.
The suitability of an arrangement may depend on the event date, location, duration, number and ages of children, and the services requested.
Submitting an enquiry does not automatically guarantee availability or confirm a booking.
5. Orders, Pricing, and Payment
Prices will be displayed on the relevant product or service page or communicated in a quotation.
Any applicable delivery charges, additional fees, and payment requirements must be communicated before the customer commits to the transaction.
Product orders and event bookings may have different payment and confirmation processes. The applicable process will be communicated at checkout or in the relevant quotation or booking terms.
We reserve the right to correct genuine pricing or listing errors, subject to applicable law and any rights arising from an existing agreement.
6. Event Quotations and Booking Confirmation
Event quotations are based on the information supplied by the customer.
Customers should provide accurate information about their event, including the date, venue, expected number of children, age ranges, duration, and requested services.
A booking is confirmed only when iNdima Kids has expressly confirmed it and any agreed booking requirements have been completed.
Any quotation should state its validity period, scope of service, price, payment requirements, and other applicable conditions.
Changes to the agreed event requirements may affect the price or feasibility of the service and should be discussed with iNdima Kids as early as possible.
7. Customer Responsibilities
Customers are responsible for:
- Providing accurate contact and transaction information.
- Reviewing product descriptions and relevant booking terms before committing.
- Providing accurate event details.
- Informing us of relevant childcare requirements through an appropriate channel.
- Ensuring they have the authority to provide information about children in their care.
- Following the agreed booking arrangements and payment terms.
Parents and guardians remain responsible for providing accurate information about their children's needs and discussing any special requirements with us in advance.
8. Event Childcare and Safety
We understand that children's wellbeing is important to parents and event organisers.
Our nannies are background checked. This should not be interpreted as a guarantee that risk can be eliminated or as a claim that every nanny holds a particular professional certification.
The scope of each service, supervision arrangements, responsibilities, and any special requirements should be agreed before the event.
Customers must communicate relevant care needs, allergies, medical considerations, emergency contacts, and other essential information through the appropriate booking process where required.
We reserve the right to discuss or decline an arrangement that we reasonably determine cannot be provided appropriately with the resources or arrangements available.
9. Delivery
Delivery arrangements, applicable charges, and estimated timeframes will be communicated on the relevant product page or during checkout.
Customers are responsible for supplying an accurate delivery address and contact details.
If a delivery delay or issue arises, please contact us using the details provided on our website.
Nothing in this section limits any rights a customer may have under applicable law.
10. Cancellations, Returns, and Refunds
Product returns, refunds, and event booking cancellations are governed by our separate Refund & Returns Policy and Booking Policy.
These policies form part of the information provided to customers before they commit to a purchase or booking, where applicable.
Nothing in our policies removes statutory rights under South African consumer protection law.
11. Intellectual Property
The iNdima Kids name, logo, original book content, artwork, website copy, and other original brand materials are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or commercially exploit our original materials without prior written permission, except where permitted by law.
12. Third-Party Services
Our website may use third-party providers for hosting, payments, communications, delivery, or other operational services.
Where relevant, those providers may have their own terms and privacy policies. Their involvement does not remove any rights or obligations that apply under South African law.
13. Limitation of Liability
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law.
To the extent permitted by law, iNdima Kids is not responsible for loss caused by inaccurate information supplied by a customer, misuse of products, or circumstances outside our reasonable control.
This clause does not exclude responsibility for our own breach of contract, negligence, unlawful conduct, or other liability that cannot legally be excluded.
14. Complaints and Disputes
If you have a concern about a product or service, please contact us first with your order or booking reference and a description of the issue.
We will make reasonable efforts to address complaints fairly and in accordance with our legal obligations.
Nothing in these terms prevents a consumer from exercising any right to approach a competent regulatory body, tribunal, or court.
15. Privacy
Personal information is handled in accordance with our Privacy Policy and applicable South African privacy laws, including POPIA.
16. Changes to These Terms
We may update these terms to reflect changes in our services, business operations, or legal obligations. The latest version will be published on our website.
Changes will not override rights or obligations that have already arisen under an existing agreement, except where permitted by law.
17. Governing Law
These terms are governed by the laws of the Republic of South Africa, subject to applicable consumer protection legislation.
